F.A.Q.

Estes Park Local Marketing District

1. Did the ballot issues pass?    Yes, both issues passed.   Issue 5D created the Estes Park Local Marketing District.  Issue 5E allows the district to levy a 2% tax on over night stays of less than 30 days beginning January 1st, 2009.

2. How can I get more information?   The best and most accurate information can be found on the internet at:   http://www.revenue.state.co.us/taxstatutesregs/salesindex/localmarketingdistrict.html

3. Has the Board of Directors been appointed and the officers selected?  Yes, the Town appointed Cory Blackman (Vice Chairperson), Elizabeth Blanchard, Ken Larson (Chairperson), Kathy Palmeri and Scott Webermeier (Secretary/Treasurer).  Larimer County appointed Bill Almond and Lee Lasson.

4.  When does the new Board take over Marketing & Advertising for the new district?  On January 1st 2010, one year after the collection of the new tax begins.  The Town of Estes Park will continue to fund and manage Marketing and Advertising for 2009.

5. Who collects the tax and how do they pay the tax?   Lodging Owners or their management companies are liable for the Local Marketing District Tax rate beginning January 1st, 2009 on all receipts from lodging when the stay was less than 30 consecutive days.  The tax is collected by lodging from the customer.  This tax is then remitted quarterly to the Department of Revenue on Form DR 1490, and must be filed by the 25th day of the month following the quarter for which you are filing.  Note: The Local Marketing District (Special District Tax) does not allow a service (vendor’s) fee as you may be accustomed to with the Colorado Sales Tax Returns.

6. How do we know if we are in the new Local Marketing District?  View the district map and the list of properties.

7. As a lodging property owner, will I receive any correspondence?   Yes, the LMD Board is sending out a letter to all lodging properties in the new District on the list we received.  If you have not received this letter by December 15th, 2008, please call Jackie Williamson at the Town (970-577- 3702) to make sure your name is added to the list.  Also, The Department of Revenue will send you a pre-printed form at the appropriate intervals. Remember, failure to receive the letter or the form does not relieve you of your responsibility to pay the taxes.
